Terms of Service
The agreement between you and Enyon Software Limited covering your use of BulbQA.
Effective · Enyon Software Limited
These terms govern your use of BulbQA, a regression testing service operated by Enyon Software Limited, a company registered in England and Wales under number 14598599, with its registered office at Union House, 111 New Union Street, Coventry, West Midlands, CV1 2NT, United Kingdom ("we", "us"). By creating an account or using the service you agree to them. If you are agreeing on behalf of a company, you confirm you have authority to bind it.
1. The service
BulbQA is a manual-first test management service. It consists of a hosted application at app.bulbqa.com and a desktop application (the "Runner") that you install on your own machines.
Your code stays yours, and stays where it is. The Runner executes scripts from your own repository, on your own hardware, with your own credentials. We do not receive, store or execute your source code. What we store is the test management data described in our Privacy Policy — cases, plans, runs and results.
2. Accounts and organizations
- An account is held by an individual and belongs to one or more organizations. The organization, not the individual, is our customer and is responsible for its members' use of the service.
- An organization owner controls who has access. Removing a member revokes their access immediately; work they recorded before removal stays in the organization's history.
- You are responsible for keeping account credentials secure and for all activity under your account. Tell us at security@enyon.dev if you believe an account has been compromised.
3. Fees and payment
- A subscription costs £95 per month, which includes up to 10 members of your organization. Every member beyond the first 10 adds £4 per month. Billing is in advance and renews automatically each month until cancelled.
- The number of members is the number you pay for. There is no separate seat count to buy or manage: adding a member increases the bill and removing one decreases it, both from the moment the roster changes. Mid-month changes are prorated, so a member who joins halfway through a period costs half of that period. An organization of 25 members therefore pays £155 a month.
- New organizations get a 14-day free trial. Nothing is charged until it ends, and you can cancel during it without paying anything.
- Payment is taken by Stripe. We do not store your card details. By subscribing you authorise recurring charges to your chosen payment method, including the charge for members added after you subscribed.
- Those are the only charges. We are not currently VAT registered, so no VAT is added. If that changes we will tell you before it affects a renewal. Any other tax that applies where you are established is yours to account for.
- If a payment fails we may suspend the ability to create new work in your organization while keeping your existing data readable. We will tell you before we do this.
Cancellation and refunds
You may cancel at any time from your billing settings. Cancellation takes effect at the end of the paid period, and you keep access until then. We do not provide refunds for partial periods except where required by law. If we materially reduce the service during a period you have paid for, you may cancel and we will refund the unused portion.
4. Your data
You own the data you put into BulbQA. You grant us the limited licence needed to host, process and display it in order to provide the service, and for no other purpose. We do not use your data to train machine learning models.
Where we process personal data on your behalf, our Data Processing Agreement applies and forms part of these terms.
Getting your data out
Your executable tests and scripts already live in your repository and are unaffected by leaving. For the data we hold, you may request an export at any time while your subscription is active. After termination we retain your data for 30 days so you can retrieve it, then delete it.
5. Acceptable use
You agree not to:
- Use the service unlawfully, or to store or transmit unlawful material.
- Attempt to gain unauthorised access to the service, other customers' data, or the systems behind them.
- Interfere with the service's operation, including by placing unreasonable load on it or circumventing rate limits.
- Resell or make the service available to anyone outside your organization.
We may suspend access without notice where we reasonably believe continued use puts the service or other customers at risk. We will restore access as soon as the risk is resolved.
6. Availability
We work to keep the service available, but we do not promise it will be uninterrupted or error-free, and we do not offer a service level agreement at this tier. We may change or discontinue features. Where a change materially reduces functionality you rely on, we will give you reasonable notice.
Note that the Runner requires a live connection to the service. Test execution is local, but recording results is not.
7. Intellectual property
We own the service, its software and its documentation. These terms grant you a non-exclusive, non-transferable right to use it during your subscription, and nothing more. You own your data and your repository, and nothing here changes that.
If you send us feedback or suggestions, we may use them without obligation or payment to you.
8. Third-party tools
Some features invoke tools installed on your own machine — for example a coding agent CLI used to review a plan or draft a bug report. Those tools run under your own accounts and their providers' terms, not ours. We are not responsible for them, and we do not receive the data they process.
9. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, neither party is liable for indirect or consequential loss, loss of profit, loss of business, or loss of anticipated savings. Our total liability in any twelve-month period is limited to the fees you paid us in that period.
BulbQA is a test management tool, not a guarantee about your software. Test results record what a person or a script observed. Deciding whether to release is yours, and we are not liable for that decision or its consequences.
10. Termination
You may stop using the service and cancel at any time. We may terminate for material breach that is not put right within 30 days of us asking, or immediately where the breach cannot be put right. On termination your right to use the service ends and section 4 governs your data.
11. Changes to these terms
We may update these terms. For material changes we will give at least 30 days' notice by email to organization owners, and the change takes effect at your next renewal. Continuing to use the service after that means you accept the updated terms.
12. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
